Attorney Review Period for Real Estate Transactions

One aspect of buying and selling real estate that happens in North Carolina that many people are unaware of is called an attorney review period. This happens after the final contract is signed and provides each party a period of three days to do a final review with their real estate attorney. During this time, they can propose changes or even elect to terminate the agreement.

If, after the three-day period is over, both parties have reviewed and accepted the contract, then it will go into effect. However, if they cannot come to an agreement, then the contract will be nullified.

Real Estate Matters Our Firm Handles

Depending on the nature of your deal, there are different issues that may come up. Our firm is able to offer legal assistance in nearly all aspects of real estate law including:

  • Transactions: Many buyers and sellers choose to work with a real estate attorney for their entire transaction. By bringing on an experienced lawyer from the beginning, you’ll have someone to consult with at every stage of the process. We are also able to assist with deed transfers.

  • Closings: Although it isn’t necessary in every state, in North Carolina you are required to use a real estate attorney during closing to do a final review of the documents and officially sign off on the transaction. We can make this process as smooth and hassle-free as possible, while also ensuring we've done a thorough review.

  • Landlord/Tenant: If you own a rental property or are currently renting, we can assist both landlords and tenants in resolving disputes and coming to an agreement. This could include concerns over late or missing rent payments, unwarranted evictions, or notice of terminations.

  • Land Use/Zoning: For real estate owners interested in developing their land, you’ll need to stay informed of all land use or zoning laws set for by the state, county, or city. Staying in compliance with these regulations is crucial so that your plans aren’t delayed and you don’t run into unexpected costs or a boundary dispute with a neighbor.

  • Residential & Commercial Lease Agreements: Finally, our firm can also assist with all aspects of residential and commercial lease agreements. We can help you draft and review documents, address disputes with tenants, and in most cases resolve issues without having to resort to costly litigation.

Why It’s Important to Hire a Real Estate Attorney

While there are some steps in the process of buying or selling a property where the law requires you to use an attorney, there are others where you don’t technically need one. However, just because this isn’t a requirement for all stages, it’s still highly recommended that you work with a reputable lawyer for the following reasons:

  • Negotiate: With home prices as high as they are these days, every penny counts. A good attorney can help negotiate on your behalf with the goal to get you the best deal possible, potentially saving you tens of thousands of dollars.

  • Protect Your Rights: With a transaction this large, you should be taking every step you can to safeguard your rights now and in the future. By consulting with skilled real estate attorneys, you can be advised and protected throughout the entire process.

  • Draft/Review Contracts: Anytime you enter into a contract with another party, you should have the documents reviewed (and ideally drafted) by a lawyer. Furthermore, because there are often back-and-forth negotiations that occur during a real estate transaction, there could be several revisions and modifications needed on your contract and these should always be completed by a professional.

  • Identify Issues: On a broader level, working with an attorney can help you identify and address issues before they get out of control. This could relate to the title, zoning, boundaries, or contract disputes.

  • Close the Deal: Finally, you’ll need an attorney to help you close your transaction.
